    KSMR Enterprises

    1. The Site is owned, managed and operated by KSMR Enterprises
    2. You must be 18 years of age or older to visit or use the Site in any manner. In the event that you are below 18 years of age, then you are visiting the Site at your own risk and you alone shall be liable for your actions. By visiting this site or accepting these Terms & Conditions of Use, you represent and warrant to the Company that you are 18 years of age or older, and that you have the right, authority and capacity to use the Site and agree to and abide by these Terms & Conditions of Use. You also represent and warrant to the Company that you will use the Site in a manner consistent with any and all applicable laws and regulations.
    3. By using the Site, you agree to follow and be bound by all terms and conditions concerning your use of the Site. Certain areas of the Site may have different terms of use posted. KSMR Enterprises shall not be liable for any damage to User’s computer system or loss of data that result from the download of any content, materials, and information from the Site or use of any software, systems, functionality, or other services on the Site. Under no circumstances will KSMR Enterprises be liable in any way for any content, including, but not limited to, inaccurate, false, incomplete, threatening, defamatory, obscene, offensive, illegal content, infringement of other’s rights including intellectual property rights, for any errors or omissions in any content, or for any loss or damage of any kind incurred as a result of the use of any content posted or uploaded.     15. For availing the services under the Site, registration by the User is required. You will receive a username and password along with account designation upon completing the registration on the Site. You are responsible for maintaining the confidentiality of the password and account and are fully responsible for all activities that occur under your password or account. By registering, you agree to the following terms in addition to any other specific terms which shall be posted at an appropriate location of the Site. Each registration is for a single individual user only. To access these services, you will be asked to enter your individual User Name and Password. Therefore, we do not permit any of the following:-
      • a) Any other person sharing your User Name and Password.
        b) Any part of the Site being cached in proxy servers and accessed by individuals who have not registered with Site as users.

Specific Prohibited Uses: The job posting and resume database features of the Site may be used only for lawful purposes by individuals seeking employment and career information and employers seeking employees. KSMR Enterprises specifically prohibits any other use of the Site, and all Users agree not to do any of the following:
      • a) Use any Site Resume Database for any purpose other than as an employer seeking employees, including but not limited to using the information in the Resume Database to sell or promote any products or services;
        b) Post or submit to the Site any incomplete, false or inaccurate biographical information or information which is not your own;
        c) Send unsolicited mail or e-mail, making unsolicited phone calls or send unsolicited faxes regarding promotions and/or advertising of products or services to a user of the Site;
        d) Delete or revise any material posted by any other person or entity;
        e) Take any action that imposes an unreasonable or disproportionately large load on the Site’s infrastructure;
        f)Attempt to decipher, decompile, disassemble or reverse engineer any of the software comprising or in any way making up a part of the Site;
        g)Aggregate, copy or duplicate in any manner any of the content or information available from the Site; or
        h) The Users agree not to use / insert any of the User’s URL, web link, e-mail address and website while posting any job on the Site.
        On non-conformance by users of any of the aforesaid terms, KSMR Enterprises reserves the right in its sole discretion, restrict or terminate the offending User’s ability to access the Site and determine whether to take any other actions whether to remove or request the removal of the User’s content. KSMR Enterprises shall have no liability or responsibility whatsoever to Users for performance or non-performance of such activities. KSMR Enterprises may take any other action with respect to User content or User actions that it deems necessary or appropriate in its sole discretion if it believes it may create liability for KSMR Enterprises or may cause KSMR Enterprises to lose (in whole or in part) the services of its ISPs or other suppliers.
    19. The User hereby specifically agrees to comply with the requirements of the Information Technology Act, 2000 as also rules, regulations, guidelines, bye laws and notifications made there under, while on the Site. The user also undertakes that the content provided by him/her is not defamatory, obscene, threatening, abusive or hateful. The User shall alone be responsible for all his acts, deeds and things and that he alone shall be liable for civil and criminal liability there under or under any other law for the time being in force.
    20. KSMR Enterprises may, if you so choose send direct mails to you at the address given by you. You have the option to ‘opt-out’ of this direct mails by way of links provided at the bottom of each mail. KSMR Enterprises respects your privacy and in the event that you choose to not receive such mails, KSMR Enterprises will take all steps to remove you from the list.
    21. KSMR Enterprises recognizes the receipt, transmission or distribution of spam emails (unsolicited bulk emails) as a major concern and has taken reasonable measures to minimize the transmission and effect of spam emails in its computing environment. All emails received by KSMR Enterprises , are subject to spam check. Any email identified as spam will be rejected with sufficient information to the Sender for taking necessary action. With this measure, along with other technical spam reduction measures, KSMR Enterprises hopes to minimize the effect of spam emails. KSMR Enterprises reser ves the right to reject and/or report any suspicious spam emails, to the authorities concerned, for necessary action, from time to time.
    22. No failure or delay by KSMR Enterprises in exercising any right, power or privilege under the Terms & Conditions of Use will operate as a waiver of it, nor will any single or partial exercise of it preclude any further exercise or the exercise of any right, power or privilege under the Terms & Conditions of Use.
    23. The Site is controlled, operated and administered by KSMR Enterprises from its offices within India. KSMR Enterprises makes no representation that Materials on this site are appropriate or available for use at any other location(s) outside India. Any access to this site from territories where their contents are illegal is prohibited. You may not use the site or export the materials in violation of any applicable export laws and regulations. If you access this site from a location outside India, you are responsible for compliance with all local laws.
    24. TRADE RULES
      • 24.1. Price and Payment
        All prices are inclusive of GST (where applicable) at the rate appropriate to the country of receipt and are correct at the time of entering the information on to the system. If for some reason we are unable to ship your goods, the value of the items that are not shipped will be refunded to your wallet in your KSMR Enterprises Account or to the original method of payment.
      • All prices are exclusive of delivery charges. The total cost of the order is the price of the products ordered plus the delivery charge.
      • Prices may change at any time, but (other than as set out above) changes shall not affect the orders for which we have sent an Order Confirmation.
      • Once you have selected all articles that you wish to buy, they will be added to your Cart. The next step will be to process the order and make the payment. To that end, you must follow the steps of the purchase process, indicating or verifying the information requested in each step. Furthermore, throughout the purchase process, before payment, you can modify the details of your order. Also, if you are a registered user, a record of all the orders placed by you is available in "My Account" area. You may use, as payment method, the following cards: Visa, Mastercard, American Express, Paytm, UPI and online banking etc.
      • To minimize the risk of non-authorised access, your credit card details will be encrypted. Once we receive your order, we request a pre-authorisation on your card to ensure that there are sufficient funds to complete the transaction. The charge on your card will be made at the time your order leaves our warehouse.
      • When you click "Authorise Payment", you are confirming that the credit card is yours. Credit cards are subject to verification and authorisation by the card issuing entity. If the entity does not authorise the payment, we shall not be liable for any delay or failure to deliver and we will be unable to conclude any Contract with you.
      • 24.2. Colors
        We have made every effort to display, as accurately as possible, the colors of our products that appear at the Site. However, as the actual colors you see will depend on your monitor, we cannot guarantee that your monitor's display of any color will be accurate.
      • 24.3. Packing
        Unless otherwise provided, we will comply only with its minimum packing standards for the method of transportation selected. The cost of all special packing, loading or bracing requested by you will be paid for by you.
      • 24.4. Shipping & Delivery
        KSMR Enterprises ships from different warehouses in the country. For orders with more than item, we may split your order into several packages according to stock levels at our own discretion. We aim to deliver orders within 3-20 working days of orders being placed. However, sometimes during busy sale periods, deliveries may take longer. Please note that Saturday and Sunday are not classed as working days. If you have not received your delivery in 30 working days please contact our Customer Services through
      • 24.5. Title and risk of loss
        Delivery to carrier shall constitute delivery to Buyer, and thereafter risk of loss or damage shall pass to Buyer. Any claim of Buyer relative to damage during shipping or delivery should be made directly to the carrier. Any claims by Buyer against Our Company for shortage or damage occurring prior to such delivery to carrier must be made within five (5) days after receipt of the goods and accompanied by original transportation bill signed by carrier noting that carrier received the goods from Our Company in the condition claimed. Notwithstanding passage of the risk of loss to Buyer, title and right of possession to the goods sold hereunder shall remain with Our Company until all payments hereunder, including deterred payments evidenced by notes or otherwise, interest, carrying charges, shall have been made in cash, and Buyer agrees to do all acts necessary to perfect and maintain such right and title in Our Company .
      • 24.6. Return of product
        Goods can be returned in designated period. Please contact our customer service for the detailed information. Customers returning goods are responsible for freight charges. Size wrong items and quality problem items can be exchanged. For defective products, if a defect or damage is confirmed on the returned products, we will give you a complete refund. The refund will be paid either to your wallet of KSMR Enterprises account or to the original method of payment. The following items cannot be returned or exchanged.
    25. Refund Policy: In case of withdrawal of the purchased plan, the withdrawal request needs to be applied within 7 days of purchase of the plan. The company would deduct a 10% processing charge and the balance would be credited to your bank account within 3-4 working days.
    26. The Terms & Conditions of Use shall be governed by the Laws of India. The Judicial Courts of law at New Delhi, INDIA shall have exclusive jurisdiction over any disputes arising under the Terms & Conditions of Use.
